Canal Crash Kills Three

WrongfulDeath3

A Fort Lauderdale area canal was the scene of a tragic accident recently when a speeding car left a roadway and crashed through a fence separating the roadway from the canal. Witnesses said that the car went over the top of trees bordering the canal before ending up in the water in the early morning hours; the car had been observed by several people driving well over the speed limit and some near the crash scene noted that they did not see any brake limits prior to the accident. Witnesses attempted to help those in the car but only the driver was able to get out. According to reports, the driver also tried to save the others in the vehicle. Though emergency personnel arrived quickly, it was too late to get the others out of the vehicle.

Recovery Through Wrongful Death Actions

Accidents such as these are certainly hard to hear about, and the family and loved ones of those who died in the accident will likely suffer from their losses for years to come. Survivors of accident victims such as these may have legal options, including filing a wrongful death action, to receive compensation for their losses. Though this remedy can never fully compensate one for the loss of a family member, it is a mechanism to at least help victims’ families cope with the financial impact of losing someone close to them. Wrongful death actions must be filed within two years from the date of the loss and must be filed by the appropriate parties; those who are able to receive compensation through a wrongful death action include the deceased person’s spouse, his or her children and parents, and any relation by blood or an adoptive brother or sister who was financially dependent on the deceased, either partially or wholly, for their support.

A Look At Wrongful Death Actions

Successful wrongful death actions have several requirements – someone must have died due to another person’s negligence or intent to cause them harm. Surviving family members who were dependent upon the deceased can recover various types of damages through this lawsuit including medical and funeral expenses, loss of support or services, and lost future income including potential inheritance. Often times it is necessary to engage the services of expert witnesses to help determine the amount of damages that are appropriate and to help a jury understand how the requested amounts are calculated.
