Accident Injures Two When Van Hits Home

Two people were injured in an accident recently, one of them seriously. The mid-afternoon crash, in which a van hit a house in Lauderhill, resulted from the driver of the van losing control of his vehicle. He was trapped inside his van for a period of time and suffered serious injuries as a result of the accident. The other injured person was a child who was inside the home at the time of the accident. The child’s mother and her two other children were not physically harmed, though no doubt shaken, by the incident. Others in the area were also affected by the crash, which caused a loss of power after power lines were downed. While the house was damaged enough to be considered uninhabitable, all involved were lucky that the outcome was not any worse.

Determination of Fault

In some accident cases, such as this one seems to be, there is little question about with whom the fault lies. In most accident cases, however, determining fault can be a long process involving a long list of expert witnesses, accident reconstruction, and testimony. Determining fault is necessary in most cases because it will determine who is liable for damages and losses suffered by each party involved in the accident. Depending upon the outcome of the accident, there may be other legal reasons for determining fault such if criminal charges stem from the incident. Fault is determined by factual evidence, which can consist of a combination of things such as accident scene pictures, testimony offered by witnesses to the accident, and reports filed by police.

What Can I Do After An Accident To Help Ensure Fault Is Determined Properly?

Any time an accident occurs, it is likely that the parties involved will go through a range of strong emotions immediately after the crash. It is important, however, to stay as calm as possible to help make a determination of fault as easy as possible. Gathering evidence at the scene by taking pictures from all angles of the vehicles involved and the accident scene itself will be helpful.  Making sure that anyone who witnessed the accident stays around to provide a statement is important, and providing clear and complete information to responding law enforcement or emergency officials will help as well. Of course, an exchange of information between the drivers is necessary and in Florida is actually required by law. Following a few simple steps after an accident will go a long way towards an accurate assessment of fault and subsequent fair treatment and compensation for losses sustained by accident victims.
