Family Vacation Dream Turns To Nightmare

Few experiences are more tragic than losing a child. When it happens in a horrific way and it becomes national news, we all feel the parents’ pain. The Nebraska family that lost their little boy during their vacation to Disney World has a long road to recovery ahead of them and their lives will never be the same. As many of us know from the news coverage, the little boy was snatched from a lagoon on the Disney property by an alligator and was found the next day not far from where the incident occurred. According to reports, signage around the lagoon area warned against swimming, but there was no warning about the presence of alligators; the entertainment complex is reportedly planning to review their signage, but for the Nebraska family, any additional warning signs will be too late.

Legal Time Limits

When something as tragic as this happens, it takes time to even get to a point where you would begin to think how to resume a normal life. Thankfully – and hopefully – most of us will never have to figure out how to do this. In cases where loved one’s death is the result of another party’s negligence or wrongful act, you may be able to recover in some way for your loss by filing a wrongful death action. The law does set forth a time limit to do so, however, which is known as a statute of limitations. In Florida, the time you have to file a wrongful death claim is two years from the date of death. As is so often the case with legal issues, however, there may be exceptions or nuances that affect your case. Speaking with a knowledgeable and experienced attorney is an important first step whenever you face a legal issue, particularly one as complex and complicated as a wrongful death action. It is important to get the information you need to know what must be done to maximize your chance of success in the courts, and making sure you act quickly enough to prevent having your case barred by the statute of limitations is the first thing you need to do.
