Tragic Canal Accident Claims Mom’s Life

Liability3

A little girl has lost her mom as a result of a tragic auto accident in Deerfield Beach during the holiday weekend. The driver, the baby’s father, and their three-year-old daughter plunged into a canal in their vehicle and were became trapped inside. Witnesses to the accident sprang into action and were able to pull the man and child from the vehicle, but were not able to get the woman out of the vehicle in time. The little girl is in critical condition after suffering injuries and needed to spend the holidays in the hospital.

What Happened?

Though there is no indication in the reports about what caused this accident, determining what happened and where the fault lies for this incident will most certainly be a part of the investigation. In so many cases, a one-car accident usually ends up being the fault of the driver of the sole car involved, but there are often other issues that can arise during an accident investigation to show that there may have been other issues present. In some single-vehicle accidents, a second car may actually have played a role in the accident – such as cases in which a vehicle swerves to avoid colliding with another vehicle that has drifted into their lane. In other cases, poor road design may be to blame. Studies have shown that a significant percentage of all vehicular crashes in the country that resulted in fatalities have one thing in common – poor highway design. In fact, according to one study, at one point in the near past this factor alone contributed to more roadway fatalities than other factors of speeding, drunk driving, or not wearing a seat belt.

Who Determines Fault?

Much of the time, auto insurance companies make the determination of who was at fault for any particular auto accident. The tools used to help make the determination can include the police reports and police citations, but in many more complex cases, accident reconstruction and expert witnesses may be necessary to get to the bottom of the matter. Particularly in cases of this type, it is important to enlist the advice and counsel of an experienced auto accident attorney with a solid network of experts to ensure that all aspects of the auto accident are properly considered when determining fault. Only after properly determining where the fault lies in an accident can an injured party be sure that he or she is filing a lawsuit to hold the correct parties liable for their losses.
