Algae and Premises Liability

Dock_Algae

What’s not to love about algae? Ask any vegan bodybuilder where they got that body from, and they will credit it to copious amounts of dietary supplements where algae is the main ingredient. Nori, that savory ingredient that gives sushi its elegant look and taste, that makes the most satisfying sound when a sushi chef slices it, is none other than algae. Every time you open your social media apps, you are flooded with messages from your former high school classmates, gushing about how wealthy they have become through selling miraculous dietary supplements made of, you guessed it, algae. What’s that you say? You’re still not convinced? Algae is gross? Spoken like a true Floridian! Leave the California rolls to California. We in Florida like our algae out of sight and out of mind. We certainly do not want it on the surfaces where we walk or the water where we swim. Floridians are a litigious bunch, but even we don’t sue people simply because algae was in the vicinity, and it was ugly and slimy and it ruined our selfie. You can, however, sue someone for failing to remove algae from their property if the algae was the direct cause of your illness or injury. If you got injured in an accident involving algae on someone else’s property, contact a Fort Lauderdale premises liability lawyer.

The Case of the Slimy Boat Dock: A Florida Story

Hurricane Erin seems to be headed north of us, but every time a super storm forms in the Atlantic, it is a reminder that almost nothing in Florida is certain except algae and hurricanes. In 2017, Hurricane Irma made short work of Veterans Beach in Sebring, and then, later that same hurricane season, Hurricane Maria came along to finish the job. Floridians know that we might be in the path of multiple storms in one season; it is pointless to rebuild until the hurricane season ends.

A year later, the dock at Veterans Beach was still in disrepair. A thick, slimy coating of algae had grown over it during the long weeks when it had been submerged in floodwaters. The dock reopened to the public, despite the slimy algae layer covering it. Danielle Bailey was a passenger on a boat one afternoon in August 2018 when, to the surprise of no one that has ever been to Florida in the summer, a terrifying thunderstorm gathered. Bailey’s party made the wise decision to moor the boat at the nearest dock and take shelter on dry land as quickly as possible. As Bailey stepped on the dock as she got out of the boat, she slipped on the algae and fell, fracturing her jaw. She sued Veterans Beach for premises liability for failing to restore the dock to safe condition before reopening it to visitors.
