Elective Procedures Gone Wrong

It was not all that long ago that plastic surgery and cosmetic procedures were rarely performed anytime other than when they were absolutely necessary. In the present case, the victim initially suffered intense pain and bruising upon receiving the injections and later experienced disfiguration and infection allegedly due to the injections.

Medical Negligence – What Does This Mean?

Under Florida Code Section 766.102, when a plaintiff is trying to recover for damages alleged to be a result of the negligence of a medical provider, the plaintiff must prove that the medical provider’s actions that resulted in the injuries did not meet the standard of care expected from a medical professional. This professional standard of care is the accepted and appropriate level of care and treatment recognized by other similar medical providers. In the case of the botched augmentation procedure, this means that others providing this same type of service would provide the same level of service. The plaintiff, in addition, needs to prove that the resulting injuries were not the results that would normally be expected or foreseen if the standard of care had been taken. It is reasonable to believe that the victim of this botched buttock augmentation procedure would not have expected disfiguration and infection to result from a now-routine procedure such as this.
